Terrell Marshall & Daudt Files Complaint Against U.S. Bank for Illegal Overdraft Fees
Terrell Marshall & Daudt PLLC, along with The Scott Law Group of Spokane Washington, has filed a class action complaint against U.S. Bank.
The class action complaint specifically alleges that U.S. Bank unfairly and deceptively resequenced the order in which debit transactions were processed so as to maximize overdraft fees that the bank collected from its Washington customers.
The U.S. Bank class action, brought by Washington residents Lori Brown and Mitchell Brown individually and on behalf of a class of similarly situated Washington residents, raises the following claims: (1) violation of the Washington Consumer Protection Act; (2) conversion; and (3) unjust enrichment.
The proposed class is defined as follows: All U.S. Bank customers in Washington State from October 13, 2006 through the date of final judgment who incurred overdraft fees on debit card transactions as a result of U.S. Bank’s practice of resequencing transactions from highest to lowest.
